You agree that this web-site, in its own discretion, may terminate any auction or use of the service immediately and without notice if (a) We believe that you are not abiding by the general rules of this web-site (b) You have repeatedly broken a certain term (c) You have listed a suspicious item (d) We believe you to be a non paying bidder. In most cases when we suspect foul play we will suspend your account/listing whilst we investigate further. If our investigation is conclusive then your account with us will be terminated. Your Conduct. You are solely responsible for the contents of your actions through this web-site. You must ensure that your participation in the selling or buying of items does not violate any applicable laws or regulations. By this we mean that you must check that you entitled to sell or buy the relevant item and that you are not prohibited from doing so by any law or regulation. You must not transmit through the service any unlawful, harassing, libelous, abusive, threatening, harmful, vulgar, obscene or otherwise objectionable material. You must also not transmit any material that encourages conduct that could constitute a criminal offence, give rise to civil liability or otherwise violate any applicable law or regulation. Membership. Membership to this web-site is only available to those you can form a legally binding contract. This web-site does not permit minors (under 16) to register. If any member fails to signup with their correct age the account will be terminated immediately. General Terms. This site acts as the window for The Alpaca Stud to conduct auctions and for bidders to bid on seller's auctions. This Web-site shall not be responsible for any damage to items during transit or during the inspection period, nor for misrepresentations and/or breaches of contract by seller. This web-site shall not be responsible for the cost of procurement of substitute goods or any losses resulting from any goods purchased or obtained. Warranties. A. For a maiden female: The Alpaca Stud guarantees that this female is reproductively sound and able to get pregnant before her second birthday. If not, The Alpaca Stud will have six (6) months from that date, to investigate and attempt to get the female pregnant at its own expence. If pregnancy is not confirmed by that time, The Alpaca Stud agree to replace the original female with a female of like quality. Any additional health charges besides reproductive or transportation to or from The Alpaca Stud are at the Buyer's expense. B. For a pregnant female: The Alpaca Stud guarantee that this female can carry offspring evident by her confirmed pregnancy no more than 30 days prior to the sale date by ultrasound. C. The Alpaca Stud guarantee a live born cria and that it will live for at least 30 days. Buyer must notify The Alpaca Stud within 48 hours of time of death and provide a veterinarian's certificate stating the cause of death and confirming that it was not caused or contributed to by the acts or omissions of the Buyer. In the case of death falling within the terms of this warranty The Alpaca Stud will provide to the Buyer a re-breeding of that female including expenses associated with that re-breeding with the re-breeding to take place at the premises of The Alpaca Stud. D. For a stud male or potential stud male: The Alpaca Stud guarantee the potency of that male; in the case of a working male by demonstration of cria on the ground or extant pregnancies; in the case of a potential stud by it achieving pregnancies before it has reached 3 years of age. If potency is not proved as above The Alpaca Stud will provide a male of equivalent quality in substitution for the impotent male. E. For a gelding: The Alpaca Stud provides no warranties beyond the details of that alpaca on this site. F. For a stud service: The Alpaca Stud will provide the service at the premises of The Alpaca Stud or by agreement, including transportation costs, at the Buyer's premises. No agistment will be charged whilst the alpaca sits at The Alpaca Stud's premises. If inducement aids are required including but not limited to Receptol this will be charged to the Buyer. If pregnancy is not confirmed within 60 days The Alpaca Stud reserves the right to require the alpaca to be removed and/or relaced with another female to be mated. Price. The winning bid will be the amount invoiced to the successful bidder with the addition of VAT. Laws. These Terms of Service shall be governed by and constructed in accordance with the laws of England and Wales and any disputes will be decided only by the Courts of England and Wales.
